These terms and conditions apply to all orders which consumers (§ 13 BGB) place on the online shop

(hereinafter referred to as "SINOIAN").
Consumer means any natural person who enters into a transaction for a purpose that is neither attributed to an commercial nor independent vocational activity.
§ 2 Conclusion of contract
§ 2.1 The presentation of the items on our online shop do not constitute a legally binding offer, but rather an invitation to place an order. Errors excepted. By clicking the "Buy now" button, you are making a binding offer to buy. The sale of our products on the SINOIAN online shop is only permitted for personal or private use.
§ 2.2 The purchase contract comes into existence if we accept your order with an order confirmation via email instantly after receiving your order.
§ 2.3 If our order confirmation should contain any clerical or printing errors, or if our prices as stated should be incorrect due to a technical transmission error, we are entitled to contest the order, with the onus being on us to provide proof of our error. Any payments that you have already made shall be reimbursed immediately.
§ 3 Prices
The prices mentioned in this online shop are gross prices in Euro including value-added German tax at the legally applicable rate as well as all other price components and do not include shipping costs. Items on sinoian.com are exempt from VAT for consumers from non-EU-countries. Net prices will be shown to consumers from non-EU-countries as soon as the corresponding non-EU-country is chosen on the shopping bag page.
§ 4 Shipping costs and duties
§ 4.1 For shipping within Germany we charge 4,95 Euro per order. Shipping to Israel, Russia and Turkey is charged with 10,95 Euro up to 1Kg, 19,50 Euro up to 2Kg and 29,95 Euro from 2Kg per order. Armenia, Canada, China, Japan and USA are charged with 10,95 Euro up to 1Kg, 19,50 Euro up to 2Kg and 34,95 Euro from 2Kg per order. Argentina, Australia and Brazil are charged with 10,95 Euro up to 1Kg, 19,50 Euro up to 2Kg and 39,95 Euro from 2Kg per order. Belgium, Denmark, France, Luxembourg, Netherlands, Austria, Poland, Czech Republic, Switzerland are charged with 10,95 Euro per order. United Kingdom, Italy, Sweden, Slovakia, Slovenia, Spain, Hungary are charged with 11,95 Euro per order. Bulgaria, Estonia, Finland, Greece, Ireland, Croatia, Latvia, Lithuania, Malta, Portugal, Romania, Cyprus are charged with 12,95 Euro per order.
§ 4.2 We deliver free of charge for orders over 50 Euro within Germany and for orders over 100 Euro for EU and non-EU-countries.
§ 4.3 Please be aware of the fact that for deliveries to non-EU countries, additional customs duties and import fees may be levied that are to be paid by the recipient.
§ 4.4 For payments per cash on delivery within Germany an additional fee amounting to 6,50 Euro is to be paid which the delivery man/delivery woman collects on location. For cash on delivery payments outside of Germany an additional fee of 9,50 Euro is to be paid which the deliveryman/deliverywoman collects on location.
§ 5 Delivery terms
§ 5.1 The delivery takes place within Germany, to countries of the EU and Argentina, Armenia, Australia, Brazil, China, Israel, Japan, Canada, Russia, Switzerland, Turkey and USA via DHL or Deutsche Post.
§ 5.2 The delivery time, unless indicated differently in the offer, is approx 2-3 working days within Germany, approx 2-8 working days to countries of the EU, approx 4-5 working days to Switzerland and approx 8-16 working days to non-EU-countries. The delivery period begins after receiving the payment for your order, except when cash on delivery is chosen. In this case the delivery period begins after receiving your order.
§ 5.3 In the event that all ordered items are out of stock, we reserve the right to deliver partial shipments at our own expense, as long as this complies in a reasonable manner with you.
§ 5.4 Should the delivery of the commodity fail through your fault, despite threefold delivering attempts, we are authorized to withdraw from the contract. Already received payments will be reimbursed immediately.
§ 5.5 In case the product ordered is not available, because we have not been supplied with the product by our distributor without our personal negligence, we may withdraw from the contract. In this case we will inform you immediately and suggest the delivery of a comparable product if applicable. If there is no comparable product available or you don't want to get such a product, we will refund any payments without delay.
§ 6 Payment terms
§ 6.1 The payment may be made via PayPal, SOFORT Banking, advance payment or cash on delivery. On our “Payment“ page you can see which payment method is available for you country. An invoice in letter form is attached to your shipment.
§ 6.2 When the advance payment is chosen, we will include our bank details in the confirmation of order and the billing amount has to be transfered within 7 days.
§ 6.3 If your payment should be delayed, the purchasing price will be subject to interest at a rate of 5% above the prime rate during the period of the delay. We reserve the right to provide evidence of and claim from the customer any greater damage caused by default.
§ 7 Reservation of ownership
The product remains our property until the payment is complete. Prior to the transfer of ownership a pledge, a chattel mortgage, a processing or remodelling is not allowed without our permission.
§ 8 Cancellation policy
§ 8.1 Consumers have the right of cancellation within twenty-one days.

Right of withdrawal
You have the right to withdraw from this contract within 21 days without giving any reason.
The withdrawal period will expire after 21 days from the day on which you acquire, or a third party other than the carrier and indicated by you acquires, physical possession of the goods.
To exercise the right of withdrawal, you must inform us (SINOIAN, Emin Bolbolian, Jaegerhofstrasse 54, 42119 Wuppertal, Germany, Email: service@sinoian.com) of your decision to withdraw from this contract by an unequivocal statement (e.g. a letter sent by post, fax or e-mail). You may use the attached model withdrawal form, but it is not obligatory.
To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.
Effects of withdrawal
If you withdraw from this contract, we shall reimburse to you all payments received from you, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than 21 days from the day on which we are informed about your decision to withdraw from this contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement. We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earliest.
You shall send back the goods or hand them over to us, without undue delay and in any event not later than 21 days from the day on which you communicate your withdrawal from this contract to us. The deadline is met if you send back the goods before the period of 21 days has expired.
You will have to bear the direct cost of returning the goods.
You are only liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics and functioning of the goods.
Exclusion or premature termination of the right of withdrawal
The right of withdrawal does not apply to contracts for the supply of goods, which are not prefabricated and which are clearly tailored to personal needs or according to customer specifications.
Download Withdrawal form§ 8.2 Please avoid damages or impurities of the goods. Please return the goods preferably in its original packaging with all accessory back to us. If necessary use a protective outer packaging. If you are not anymore in possession of the original packaging please ensure that the goods are packed appropriately to protect against transport damages.
§ 8.3 Please return the good as an stamped package and retain the certificate of delivery. On request we can reimburse the postage costs in advance, provided that you don't have to pay them yourself.
§ 8.4 Please consider that the modalities stated in the paragraphs 8.2 to 8.3 are not preconditions for the effective execution of the right of withdrawal.
§ 9 Damage in transit
§ 9.1 In case goods are delivered with apparent damages, please complain to the delivery man/delivery woman immediately and contact us as soon as possible (service@sinoian.com).
§ 9.2 The failure to file a complaint or to contact us does not have any influence on your legal warranty claim. However, this way you help us to be able to claim our compensation from the carrier, respectively the transport insurance.
§ 10 Warranty
The warranty is granted in accordance with statutory regulation.
§ 11 Final provision
Should any provision of these general terms and conditions be void, this will not affect the effectiveness of the remaining provisions. The relevant statutory provisions will apply in place of any invalid term. The law of the Federal Republic of Germany shall apply to the exclusion of the CISG.
